Can I Lose My Gun Rights in Virginia for Domestic Violence?

courtroom

Virginia Code Section 18.2-57.2 makes any assault and battery against a family or household member a class 1 misdemeanor in Virginia.

Under Virginia law, a conviction for domestic violence will not impact you firearm rights. However, on the federal level, the Violence Against Women Act (VAWA) and the Gun Control Act of 1968 make it illegal for anyone convicted of a domestic violence misdemeanor, or anyone subject to a domestic violence protective order, to possess firearms or ammunition. Therefore, a conviction under Virginia Code Section 18.2-57.2, will in essence terminate a person's rights to possess or purchase a firearm.

Unlike other offenses, there is no mechanism to for a person convicted under these acts to get their gun rights restored. Therefore, the right attorney to protect you from this type of outcome is critical.
